These Terms of Service ("Terms") govern your access to and use of the website at flourishwcvb.com (the "Site") and any services provided by Flourish Wellness Center of Virginia Beach ("Flourish," "we," "us," or "our"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. Medical Disclaimer

Use of this Site, including the chat widget, does not create a doctor–patient relationship. A doctor–patient relationship is established only through a formal consultation with Dr. Diana Stafford after appropriate intake and informed consent.

2. Not a Substitute for Emergency Care

If you are experiencing a medical emergency, call 911 or go to your nearest emergency room. The Site, our chat widget, our SMS program, our voicemail, and our email are not monitored continuously and are not appropriate for urgent or emergency communication.

3. Use of the Site

You agree to use the Site only for lawful purposes. You agree not to:

• Use the Site in a way that violates any applicable law or regulation
• Attempt to gain unauthorized access to any portion of the Site, our systems, or other users' data
• Interfere with or disrupt the integrity or performance of the Site
• Upload or transmit any malicious code, viruses, or harmful material
• Scrape, harvest, or otherwise collect information from the Site by automated means without our prior written consent
• Impersonate any person or entity or misrepresent your affiliation

4. Intellectual Property

All content on the Site — including text, images, graphics, logos, and design — is the property of Flourish Wellness Center of Virginia Beach or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws. You may view and download content for your personal, non-commercial use only. Any other use, including reproduction, modification, distribution, or public display, requires our prior written consent.

5. Appointments & Cancellations

Appointments are booked in advance through our chat widget, by phone, by email, or through our scheduling system. We require 24 hours' notice for cancellation or rescheduling. Late cancellations and no-shows may be subject to a fee, which will be communicated at the time of booking.

We are an out-of-network practice and do not bill insurance directly. Payment is due at the time of service. We accept major credit cards, HSA, and FSA cards. Superbills are available upon request for potential insurance reimbursement.

6. SMS / Text Messaging

By providing your mobile number to us — through our chat widget, by phone, by email, or in person — and consenting to text messages, you agree to receive text messages from Flourish Wellness Center of Virginia Beach for the purposes of appointment confirmations, reminders, scheduling changes, and care-related communications. Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time. Reply HELP for assistance.

7. Third-Party Services & Links

The Site uses third-party services, including a hosted chat widget for communications. The Site may also contain links to other third-party websites. We are not responsible for the content, privacy practices, or terms of any third-party service or website. Your use of those services is at your own risk and subject to their respective terms.

8. Disclaimer of Warranties

The Site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Flourish disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability. We do not warrant that the Site will be free of errors, secure, or continuously available.

9. Limitation of Liability

To the fullest extent permitted by law, Flourish Wellness Center of Virginia Beach, its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Site, including but not limited to damages for loss of profits, data, goodwill, or other intangible losses, even if we have been advised of the possibility of such damages.

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law.

You agree to indemnify and hold harmless Flourish Wellness Center of Virginia Beach and its owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Site, your violation of these Terms, or your violation of any rights of another party.

11. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Virginia Beach, Virginia, and you consent to the personal jurisdiction of such courts.

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
