3. SMS / Text Messaging Terms

Program description

Flourish Wellness Center of Virginia Beach operates an SMS program for the purpose of appointment confirmations, appointment reminders, scheduling changes, and care-related communications. By providing your mobile number to us — through our chat widget, by phone, by email, or in person — and opting in to text messages, you consent to receive SMS messages from us at the number you provide.

Consent and opt-in

SMS opt-in is collected directly from you, with explicit consent, at the point you provide your phone number. When you provide your number through our chat widget, we will explicitly ask whether you consent to receive appointment-related text messages, and you may decline. Consent to receive SMS messages is not a condition of any purchase or service. You may decline to receive text messages and still receive care from our practice — we will simply communicate with you by phone or email instead.

Message frequency

Message frequency varies based on your appointment activity. Most patients receive between 1 and 6 messages per month, primarily related to their scheduled visits.

Message and data rates

Standard message and data rates may apply, as determined by your mobile carrier. Flourish Wellness Center of Virginia Beach is not responsible for any charges imposed by your carrier.

Opt-out (STOP)

You may opt out of receiving text messages at any time by replying STOP to any message we send. After you reply STOP, you will receive a confirmation message and no further texts unless you opt back in. To opt back in, reply START or contact us directly.

Carriers

Supported carriers include AT&T, Verizon Wireless, T-Mobile, Sprint, Boost, Cricket, MetroPCS, U.S. Cellular, and others. Carriers are not liable for delayed or undelivered messages.

No sharing of mobile information

We do not share, sell, rent, or transfer your mobile phone number or SMS opt-in consent to any third parties or affiliates for marketing or promotional purposes. Mobile information may only be shared with our SMS messaging service provider (acting as our processor) for the sole purpose of delivering the messages described above.

4. How We Share Information

We share information only as needed to operate the practice and as permitted by law. Specifically:

• Service providers: we use trusted vendors for scheduling, secure messaging, telehealth, payment processing, email delivery, and analytics. These providers may access information only to perform their contracted functions on our behalf.
• Healthcare partners: with your authorization, we may share PHI with laboratories, pharmacies, specialists, or other healthcare providers involved in your care.
• Legal compliance: we may disclose information if required by law, court order, or to protect the rights, property, or safety of Flourish, our patients, or others.

We do not sell your personal information. We do not share mobile opt-in data or SMS consent with third parties for marketing or promotional purposes.

5. HIPAA & Protected Health Information

If you become a patient of our practice, your PHI is handled under HIPAA. You will be provided with a separate Notice of Privacy Practices ("NPP") describing your rights regarding your PHI. The NPP, not this online Privacy Policy, governs the use and disclosure of your PHI in the clinical setting.

6. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect your information from unauthorized access, alteration, disclosure, or destruction. However, no method of internet transmission or electronic storage is 100% secure, and we cannot guarantee absolute security.

7. Data Retention

We retain personal information for as long as needed to provide services, comply with legal obligations, resolve disputes, and enforce agreements. Medical records are retained in accordance with Virginia state law and applicable federal regulations.
